In that case I'm afraid I have no idea, sorry man. Did you actually proceed with the installation when it said you already had it, or did you back out?
it wouldnt let me proceed with the rest of the installation
In that case I'd try what the other guys have mentioned; uninstall and reinstall it. You might want to use something like Revo Uninstaller to make sure you get all of the lingering system files.
That said, it's definitely not a game issue, but rather a computer one, despite it being brand new, so I wouldn't give up and ask for a refund just yet.
