I only pvp, but i don't understand your question?.. anyone who can afford a golem should be able to siege.
From what I can tell there are risks associated with being 2 of the parties:
The defender risks the loss of their stuff
The attacker risks the resources of the golem vs the defenders and their spoils vs the 3rd party vultures if they win
The 3rd party risks nothing, so far, so why should they get free resources for just seeing the announcement in chat / on the map? Instead, you can just be patient. All it takes is waiting 2 minutes to see if the attackers win. If the attackers win they will loot the castle and then you can swoop in, attack them, and take their loot.
So why would the feature be added to further increase the risk of being the attacker? They are already the ones paying to make the attack so... what's the point? Technically it already exists if the 3rd party is patient... just wait 2 minutes. That's it.
Building a golem would become a liability because every other team who wants to build golems can just wait for you to build one, come clean you out, and then still have the opportunity to take the defender's resources. All it does is increase the risk of being the attacker for the duration of the siege and it incentivizes 3rd partying instead of incentivizing being the assailant.
As you said, as a third party you can already just wait until the attacker has won and swoop in. So the risk that attackers loose everything to a third party is not a new thing. Which means there is no new risks at all. Building golems is already a liability, again because of what you said.
And remember this also ensures that the original attacker can come back, and retake their golem. It adds more chance for PVP, and also gives defenders a chance to fight everyone in a massive battle if third parties try to counter.
