Sony has been rather chill about this sh*t, so I'm optimistic.
Also it's sometimes only written deep in the EULA like for Football Manager 2022, from recent memory. In the past few years publishers frequently forgot to mention the middleware but it fortunately became less of an occurence due to a recent modernization of the European framework regarding interoperability and the encryption of digital goods.
Now, I don't think Sony will ever use Denuvo. For the story, Denuvo is a former branch of Sony DADC they wanted to close and that the employees purchased through a management buyout then sold to Irdeto. Can't imagine any execs accepting to pay for a liability they tossed away right during the BMG rootkit scandals and SecuROM lawsuits.
