I can't say if it's intended or an oversight this time but it's pretty common really.
I guess if they had a mana pool or limited stamina you could just drain them at the start and then they would be virtually broken so I can see why they might not give them the limits we have. We can chug potions and I have not seen them do so unless they reset on their leash or pick themselves up after an NPC fight. If they could use a few potions and had the same stamina pool etc then meh... maybe. Also keep in mind that the fight you show stays at that level so later you can come back and smack him twice with an axe and he falls over. Maybe you are taking on stuff a little above your pay grade just now? Finish a few more quests, upgrade your gear, clean up the easier content, level up a bit and then try him again. This sort of thing is how open world games like this one work. You often end up walking into fights you are a little unprepared/undergeared for.
