lol I dont care where its from bro. The terms basically state, if you agree to install and use the program that if it ever has malicious software that gets patched in, that they are NOT liable in any way for it.
As for the Terms on the site, all the site says is that they take no responsibility for any viruses you may get (or think you get from using the site.)

Also the wording in the EULA is very specific as to saying that Digipen cant assure you that the program is going to be virus free, why not? they literally should be the only ones developing it and maintaining it. So if their own software gets corrupted, its somehow not their fault? lol

That is simply because this game is a UE4 game and does not have an FPS limiter. As with most engines that utilize deferred lighting, UE4 can be extremely fillrate-heavy, and even geometrically simple scenes can consume a lot of GPU resources.
As far as the main menu, when building it I enabled volumetric fog to enhance the effect of the light coming around the corner. I figured since it was the main menu, very high fps wasn't a priority.
I'm not sure why people are "worried" about GPU usage, since you're probably not doing anything else with your GPU when you are playing the game anyway. Anyway, if you look at the GPU usage graphs in Task Manager, you can see that almost the entirety of the GPU is being used for "3D". One would imagine that mining would show up as Compute.
In short: Such an EULA is a normal, standard practice, that basically says in legal terms "Digipen didn't make this, Digipen isn't responsible for this, and if something is ♥♥♥♥♥ with it, you agree that it isn't our fault."
