Overwhelming presence not working?

Is anybody else having an issue with overwhelming presence where it constantly spams "confusion" whenever the mouse is hovered over the enemy? In addition, I've noticed it doesn't actually do critical damage even if your armor is higher than your engaged opponent.

Aside from the confuse spam, who is really buggy, especially on BEARS...
Causing them to be Immortal cause they cannot gain Beserk.
(but that issue is solved once they gotten a turn)

The critical often works. cause my Brute doesn't have superior critical hit rating of 65%.
So I do get chain criticals, especially on engage. but sometimes disenaging and engaging doesn't seem to trigger it. but when I move them it works again.

I had an average fight last night where half the enemy were DEFENDERS... multiple hits. riposte always and Confusion.. had to use new tactics...
