As for whether it's legal – probably not. Most likely, CHIP didn't read the license properly, and so far Rockstar hasn't complained. Despite a lot of people claiming otherwise, Rockstar did not release GTA 1 and 2 as freeware/shareware. They just distributed them freely for a while, which is a big difference, as while you could still get the games from the Rockstar Classics site, the license clearly stated that other websites are not allowed to mirror and redistribute the files. You could only get them for free legally from Rockstar directly, and that offer expired when they took down Rockstar Classics all those years ago.
If you really want the game, the best option might be to try and find a used physical copy. The old versions from '97, ironically, work a lot better on newer versions of Windows than the supposedly optimised ones (I believe they were optimised back in XP days, so that may be why). Also, the digital re-releases have some issues with the music tracks being all mixed up.
This might be "while supplies last". The description of the Collection on Green Man Gaming has been changed to no longer include 1 and 2, same as on Steam proper. They might just have some of the old keys left from before the removal, so no guarantees.
this was the one right? and it probally is limited, but doubt theyd run out easy due to the developers tend to give them a large stock of keys.
so unless everyone went crazy and bought a chunk of them should still be a chunk of them left.

That's the one – if you read the reviews, a lof of people say the games were included. The last one to do so seems to have been in September, though.
They were officially part of the package from early 2008 to late 2012, in Grand Theft Auto Complete Package (appid 4466):

The new package is called Grand Theft Auto Collection and has appid 28987. That change might have happened at the same time as the removal of the top-down games.
which i didnt leave a review, so going by review wise can be a hit and miss sometimes.
so hopefully they didnt run out yet, but if they did they did, still i doubt theyll run out anytime soon hopefully.
as only so many care about 1-2 due to not being able to run it, that and so many care about the newer games more then old sadly.
