Bonus to stat don't count for requirements. You need a real LV 28 CL.
For the OP, dunno what your goal with Dragon Disciple is but most people that use it take it up to level 4. That's the point where what you get, more or less, is worth the single lost CL. But that's your decision to make based on your build's goals.
The usual build for 10/10 sorc DD is to do a dragonkind melee build and hit like a truck in dragon form. Otherwise there is no real point.
You are right in what you are going for Fox, most people would say the cut off point for DD is 4, just like Zen Archer is 3 (or 11) - but hey, any build can be fun, fun is subjective :)
Edit: just tested the robe on a Sorc10/DD10 MR10 Lich and the robe does NOT increase the CL shown in the spellbook window (CL27) and thus does not allow the character to qualify for level 10 spells. The robe's +3CL bonus does work properly when casting spells, though, so I'm guessing it works as intended.
Strictly what is show in the 'Spell Book' window as a character caster level in that class is what is required for any Prestige/Mythic advancement .... Dark Rites, Robes, Staves etc don't change that, you are correct. Levels count, only levels, not items/abilities.
Correct ... -1 for DD2 and -1 for EK1.
Incidentally, although only on Hard, I have made Seelah as close to this as possible, she still smashed things.
