Legend Inheritance?

I started playing as Count Guifré "the Hairy" and created a Legend using the "Heroes of Old" dynasty perk seed. However, once I died, instead of my playable heir inheriting it, the legend is now owned by my second son. Is there any explanation to it? Do legends have a succession order anyways?
