i don't see the truce on the diplomacy space but it says that if i declare a war i will break a truce

Check your character screen; truces are in the same spot as Alliances and wars. Hover over one and it will tell you when it ends.

that's the thing, they aren't there

5 years isn't it? Are you 100% sure it's not on the right hand side of your character screen under all your alliances like Zsrai said?

This only shows your own truces. If someone else declared war on you and you want to know if they can do it again soon, you'll have to check that characters screen. Under alliances as others have said.

Must be, although it's not one I'm aware of. If you attacked them then you're the one with the truce so it should be in your character's treaties bit. Has it been 5 years and you're still being told you'll be breaking a truce?

Do you still have a truce with them? Your chancellor's default job has a chance to cancel out truces. They are also character based, so if you war with someone, win, then they die 1 year later you can declare war on their heir again.

Are you getting the warning when you go to Declare War that you're gonna break a truce?

the truce didn't last forever, also i really do wish the truce showed up for both sides

Truces are one sided. If I attack you, I have a truce with you. You don't have one with me, meaning you can attack me if you want. Otherwise the loser gets double punishment.

I don't think that that's how it works. Only one side has the truce. If A attacks B, ending up with a 5 year truce, that does nothing to stop B from attacking A. So it only shows the one side because there is only the one side.
EDIT: what Zsrai said

I didn't realize that truces in CK3 were one sided. I assumed they worked like in other Paradox Games, and you know what happens when you assume...
[FuFo] Mortucus Jun 2, 2021 @ 11:16pm
click on the empire and then bring up the rulers screen in his alliance and treaties section put ya mouse pointer over you're flag and it will show the date the treatie ends
[FuFo] Mortucus Jun 2, 2021 @ 11:17pm
to add you can break treaties and peace deals all you suffer is a prestige hit
