Second Empire created upon death???
i was the emperor of scandinavia. when i died i got the empire of scandinavia and the empire of britania was created without me choosing to do it for my brother. and thus my empire was split in two.

I loaded an older save an tried to create the empire of britania myself before i died. and this time i got both empires myself?

Is this a bug?

Confederate Partition creates new titles if possible. Elective Gavelkind used to do that in CK2.

All my titles are "Scandinavian Elective" it only happend that one time, never seen it before.
Also never seen it in ck2. A empire title would not be created. but if your character is holding 2 empire titles they would be given to two diffrent kids, and the empire would split in two
Your titles have "Scandinavian Elective" not your realm. It dosent matter what kind of law do you have on title.
But until you can reach different partition you will need to manage 2 empire titles preferably with elective form or one as primary with partition (that will always go to your older son etc) and second one with elective scandinavian, preferably where you have main lands as you will have better vote power here.
Also you should have notice in succesion tab that this empire title will be created.

Regular partition is reachable in early medieval tech so as long as you don't expand too fast too early and just hold one empire you can keep everything together...then you can grab partition and it won't create new titles...that being said...if you have multiple empire titles, unless the same heir gets them, they will split off.

You shouldn't have created a 2nd empire tittle. Not until you can give them all to your heir on succession. Look at the succession tab and you see what tittles you will loose on death.

It won't matter if you have confederate partition, it would still create the title. This would only work under regular partition (gavelkind).

His got two empires so it's safe to assume he does not have confederated partition, since he would have had this issue long before this. Problem is that next partition still inherits equally so two empire tittles are equal in value so the other gets given away and creates a 2nd emperor. While your brothers whom inherit kingdoms still remain under your rule.

Emperor > King
