Eyebite: Asleep spell bypassing Fey ancestry

I am playing half elf on my playthrough
I am at the fight with Cazador and one of his minions
Catterteeth casts the spell Eyebite:Asleep that seems to bypass Fey ancestry and put me to sleep. Its it counter-able by Counter-spell so that would make it a Spell and in turn a magical affect that is putting me to sleep. As a half-elf.
Is this intended or just an oversight.

I'm not sure on intention, but I had the same thing happen to me last night on my wood elf fighter and Shadowheart.

Just had this happen to me too. Very annoying since I opted not to counterspell (Drow are immune to sleep, so...) and the game dropped me to sleep and cancelled a concentration spell. Shouldn't have happened.

I don't think Fey Ancestry works at all, I've been slept by other characters too in the past.
