Shadowheart Story Oversight?

Shadowheart left my party in Act 2 because I freed the Nightsong and I've now arrived at the House of Grief in Act 3.
The conversation with Viconia DeVir has been bizarre because she seems to think Shadowheart is still part of my party. The game even goes out of it's way to tell me she's used Detect Thoughts on me so she should know that Shadowheart left.

Now I'm being asked to 'surrender Shadowheart to her' and my options are 'No you can't have her' or 'I'll bring her to you' which both make zero sense when she's not even in my party anymore.

Was this an oversight or is a story flag not being triggered when Shadowheart leaves?

yeah this happened to me too, i noticed a lot of inconsistencies and bugs in act 3 during dialogues, i hope these issues get sorted out in coming patches because it really ruins the moment when im immersed in the game

Larian forgot to update the dialogue and choice fork.
There are a few instances like this.
