Sleeping NPC VS. Theives

Apparently the NPC is knocked out due to some magical force that may or may not have been me. However, despite being knocked out cold when I attempt to pick a lock/do my thieving deed, the supposed sleeping NPC wakes up and calls the guards! How and why?

(Also right now, not sure if it's just my computer being garbage or the game's current state, but I can't load saves in game or it crashes. I have to restart the game so that makes any mistakes or possible bugs all the more painful. My loading times are between 5-10 minutes so it reeeeaaaallly sucks.)

Was the sleeping NPC a drunk goblin or bugbear? It may simply be game logic that sleeping NPCs wake up when you steal from them.

No, it was a Tiefling. It's the guard who took a potion and her legs stopped working.
