Stealing from Kithric does not mean you automatically get away with it. Kithric no doubt realized the Shard was missing and knew there was only one place to use it. Thus, you were caught. Now the Shard is secured somewhere safe. Away from thieving hands.
In short, the developers knew that some would try and do this and planned for a logical outcome.
I bet if you had not been able to 'talk' your way out of a fight, you might have found it on his body. But once you let him walk off with it? Could be anywhere. Or nowhere.
There is no way that this is not a bug because when I inserted the shard there was a short dialogue/cut scene that was interrupted by Kithric so the shard was already inside the generator thingy and the barrier should have been opened.
So, she took it out of the generator. I know you don't like the outcome of your actions, but that's the way it goes in this game sometimes. Instead of fussing over it, just move on. :)
What you describe is exactly what I would expect to have happened if the developers had taken stealing the Shard into account.
You cannot just do whatever you want to do in this game and then expect that there will be no consequences or repercussions. Your choices matter.
If you cannot find it, you should send a bug report to Larian. But this would sadly not help you fast enough, if it would help at all.
Sounds like you glitched that out. But you do not need that part to progress with the story.
Make sure to clarify how you got through the conversation after you got caught.
Larian likes to have robust safeguards anticipating different tactics from players and it sounds like Kith'rak should have the item on them after the conversation, or lying nearby, or back in your inventory. Depending on what happened in the cutscene.
If Larian agrees they'll add it to the todo for future patches.
Other than that, good thing it doesn't break your Honour Mode play-through as Pomacanthus pointed out above.
Stuff happens, though. My last game, the statues would not turn to open the BOL area, so I could not claim it.
