Surgeon's achievement says 'IN COMBAT", the toll collector's does not.
I thought that at first too but "in combat" in this case by semantic rules is applied to "surgery", therefore if the surgery is not performed on a player in combat the condition is fulfilled, and if there was no combat the condition is fulfilled implicitly. If we were meant to kill him in combat specifically it would have been "Kill the Surgeon in combat before he performs surgery on you."
So it is either a bug or an ambiguous condition.
Or it's just poorly worded. Which is the most likely answer. I talked him to death too and got no achievement.
When it didn't pop off the first time I thought maybe it was because there was another fight in Act 3 or something and this wasn't the surgeon.
Looking back it probably means after combat has initiated and he's agro'd.
