So it's for those scripted times were you are suppose to pickpocket.
Even if you are lucky or spend time setting up distractions, as soon as the deed is done someone will spawn next to you and send you to prison. Pickpocketing, very frustrating. They have just give you the impression you can, but the game say's no.
You need to be close enough to touch, stealthed, and have a full action point ready. Having the turn paused is helpful, but it works best to stealth and then pause (so you have an action ready).
It takes a minute to get the hang of it, but once you do you can steal from everyone. In some cases you'll need to do something to manage the narcs watching the shopkeeps, but there are a lot of ways to influence where people are standing and looking.

Ungroup sneak up, pickpocket an item wile paying attention to the difficulty of it, then turn around and get away from him. You can succeed stealing the item but then they will realize it is gone. So you have to be far enough away from them.
I find it easier not in turn mode.
That isn't how it works. I'm not trying to offend, just letting you know that you've misunderstood.
Action points come back every turn, resting is not related.
Pickpocketing is not a character-specific ability. It is what happens when anyone clicks on a person/monster/whatever while being hidden and within touch distance. If you have a lot of Sleight of Hand skill you'll be less likely to get caught, but ANYONE can make the attempt.
It's not true you just have to not be standing around when they figure out that they are missing something. I've pickpocketed successfully before and not had any issues.
Yes but even when you succeed some NPC will spawn there right in front of you and bam! Your caught. I have tried many time to pickpocket and when I succeed this always happens.
As far as being blackened out, I can only guess you're in turn based and out of Actions.
Otherwise maybe it's a glitch, reload save. The only other possibility is something with the characters. Go look at your status' and the enemies stats through examine.
Are you obscured or in a brightly lit area? Are you wearing armor that gives you stealth disadvantage? It's not just sight that matters, you make noise too. I've yet to get caught stealing even at the inn in act 2, and I use Lae'zel to do my pick pocketing. Going into hiding when the NPC knows your party is still there isn't going to work. Make your party disappear somewhere.
Ah! If the merchants are already suspicious of you, they won't turn their backs to you, which means you won't be hidden while close enough to touch them.
There are ways to repair your reputation, the simplest being bribery (just barter some stuff to the merchant, but trade your stuff for nothing in return), but it is still possible to steal from someone who is suspicious of you. Admittedly, it's a LOT more work.
Try a distraction! Minor Illusion cantrip works great, or in a pinch you can try having a friend do some street music. Music is a good distraction, but people tend to arrange themselves in a circle around the performer which can mean that everyone ends up watching each other.
And if you're not in turn-based mode, you can't be out of actions!
