I didn't take the contract, but I did sneak into the house of hope to steal the hammer. It was a good fight. I had the spell from the Necromancy of Thay and poor ole Raphael was paralyzed through most of the fight lol.
You need to kill him at home to permanently get rid of him.
This whole conversation in game brings up - not for the 1st time in this game - the lack of any way of 'telling' your companions "wink wink, play along..." and they just believe you actually mean to go through with whatever you're saying. No chance to have dialog afterwards or anything. Can't recall which, but I have seen a game where the relationship system was used, and the options were like 1) Agree to contract, 2) (lie,) Agree to contract, etc... Something like that could be used to make it so when you are faking it, your dearest friends that for gods' sakes, share an intense psychic bond with you, don't just automatically think you're either a bastard or stupid. Unless you are, then that's fine.
Later in the game you will need the hammer either way. If you didn't signed the contract you can steal the hammer from the House of Hope. If you signed the contract you can go to the house of Hope and steal your contract instead (as you already have the hammer)
