WTF does it not being an MMO have to do with the choice in mechanic?
I don't think people would like the usual route of increasing DCs on retry - given how cranky people get over dialog options they didn't get to see because of a bad roll.
They only break when you fail the roll.
Playing a rogue I haven't noticed this going wrong.
IIRC that was how they worked in EA.
So if you are greedy or you haven't got a good rogue you will break a lot of tools. If you do have a good thief and you don't try to pick locks that are too hard for you then you will find/loot thieves tools faster than you break 'em.
if yours are disappearing on a pass, you are bugged.
I believe they only break if you fail the attempt.
