Hijikata just like Kondo works for the goverment. And I'm guessing, since Kondo the commander of the Shinsengumi was involved in such plot then the Shinsengumi would've been disolved. I want to think that Hijikata stud up against that, even if it meant being the dogs of the government he wanted to keep alive that what the Shinsengumi meant for him, for Okita and for Yamanami.
Even though they know Shimei and all that, in the end to everyone's eyes he did run away with Yamanami without telling anyone.
