But i thought Subverse was a good name as every backer, and i didnt even know about Tim´s Media Outlet, i only watch him at TimCast, Youtube.

Expressive works have much leeway to use trademarked terms. There is something called the Rogers test, which in its most basic form says expressive works do not violate trademark as long as the used mark has some creative relation to the work, and does not explicitly mislead as to the source of the work. This test has been applied to music, movies, video games, basically anything creative.

FOW is perfectly in their rights to use a words that mean "to subvert" and sounds like universe, a perfectly apt name given their sci-fi setting and the tone they have portrayed the game as having, which is quite mocking and subversive.

The only one who has made 100+ replies to Tim Pool threads in the last few hours is you, fanboy. People bringing up the brand/copyright issue aren't like you at all.
In answer to the OP, no, not likely. A good few of them will be too swept up in making themselves into what they've fought (killjoys) to see reason. Already talk of massreporting to Steam and Kickstarter, etc.

Somebody might want to let the FOW folks know to close the storm shutters, the usual brand of malarkey is sweeping in.
He owns the trademark inside the United States. Period.

You have 3 options:
> Don't do business in the US.
> Change the name of your business for the US.
> Get told by a US court to do #2 and have to shell out a ton of money plus a lengthy court battle.

This is Federal law. There is no version of this where this game wins.

Tim has rights to Subverse in the US because of common law trademark. He uses "TM" in his videos. It doesn't matter if he only federally registered it on April 8th 2019. He can show proof of prior usage years before.
Wait until Tim Pool threaten Marvel because of Deadpool or Gwen Pool. Or anything Pool in general. This is like Candy Crush all over again.
The Company making the game is based in Manchester, UK. The registered the copyright there, before they went public with the campaign.

They did not steal anything from Tim, the title is an obvious play on words. They own it in the UK and have every right to use it.

I actually watch timcast, but never even heard of his other channel. This doesn't have to be contentious.

Either way, the kickstarter is kicking butt... had already blown past it's stretch goals, and now if anything, this is spreading the word ever further.

He filed the trademark for "Subverse" in the US years ago, his channel gets 33 mill monthly viewers. You can't deny there's a possible motive for taking a well trending name and slapping it on a product to increase visibility.

Also, because StudioFOW told him to lawyer up when he asked if they could simply change their name, then it doesn't matter what StudioFOW really did. Now they're getting sued for stealing trademark, thats not a good look for them. This will be damaging to both parties if they don't settle out of court. Which they should, changing the name won't hurt them at all.

Damaging? Maybe a dent to StudioFOW finances, but who gonna be mad at StudioFOW? There will be plenty who will be mad at Tim Pool, and his reputation will go down into the ♥♥♥♥♥♥♥ while StudioFOW reputation will just rise because of Tim being salty.
I am a fan of Tim I am now a fan of this now that I know it's exists, can't you guys just share the name lol.

i'm skeptical about their ineptitude, to me it seems like they indeed googled tim pool's name after he reached to them and only after that discovered his trademark, then proceeded to steal the name and got an answer ready in advance for when he reached them again

This is fiction. The came up with a name that fit the game, sought the TM, and legally obtained it. Tim didn't care until it became clear it was more popular than his moribund media venture.

Why this is great for the game, it's mass advertising. Even if they have to spend money on a lawsuit the mass attention will make it a worthwhile investment.

It's great for them, the more angry his fanboys get the more attention the game will get.
