Content ID dispute
Zimbalam (it would appear not sure if it was auto-flagged or they initiated) has made a ContentID claim on a video I've had up forever back from when the game came out on Steam. Just 9 minutes of me playing (poorly) 1 or 2 levels

Should I dispute this? Under what grounds? (fair use? Dev gives permission? The fact I own the soundtrack? They are all options but some of these dispute options seem like honey traps for stupid people)

Zimbalam have been a real pain in the arse - the musician through selling his music on amazon store, got auto added to Zimbalam.
Zimbalam will plonk an advert on any youtube videos showing Aqua Kitty music.
We have repeated asked them to delist the music from their records but with no response.

If you accept the content claim, then then an advert will appear overlaid from the time the music starts.

I am hoping we can resolve this issue with Zimbalam as its very annoying for everyone :/

I'm going to dispute it because I like making myself miserable.

But just wondering if I can get "written permission" for my use so I have some kind of leg to stand on (its clear you imply permission, but you know how lawyers are with ambiguities)

I'm also in the same boat (or submarine) with this situation.

I am also going to dispute the claim linking to this post as Tikipod have expressed they have also disputed Zimbalam and are attempting to resolve this situation.

I am also wondering if I may also request "written permission" for my use as the portion flagged is within gameplay?

I also purchased the Soundtrack previous to even considering or making my video as well to support the artist. I understand they have the artists best interest by making the claim, but I view it's also Zimbalam making a Jellygrab for advertising revenue.

Just thought I'd update on the situation osgZach and Tikipod,

The dispute I filed to Zimbalam has been released.
-------------------------------------------------------------------------
"Electric Cafè-Kitty Rock", sound recording administered by: 6:11
Zimbalam Claim released.
-------------------------------------------------------------------------

and now I have had another claim of a "Musical Compilation".

-------------------------------------------------------------------------
"Mouldy Depths", musical composition administered by: 8:05
One or more music publishing rights collecting societies
-------------------------------------------------------------------------

As the claim has been initiated not by Zimbalam, I may not be able to use the details provided by Tikipod to dispute this new claim.

At this rate, I may have to remove the video from my channel if this continues.

It saddens me greatly with this as I mentioned above, this is a great game and I am happy to support Indie Game Developers as this is such a great game!

They don't even identify who the claiming parties are?

God I hate Youtube.. I'm so glad open source initiatives have started taking off

I agree osgZach.

I have only just started in the last 2 weeks with my Channel and was making an "A to Z" series showcase of my steam library (as I have over 700 titles) I thought it would help in Indie Sales as well if my channel started to gain some popularity of which I am guessing you are also attempting to do.

As this title started with "A" it was the first I wanted to showcase as a lot of my friends have not even heard of it. All I wanted to achieve was some advertising for Tikipod for their fantastic game and hopefully generate interest to boost sales so they have extra revenue to produce another quality title like they have here.

Sadly, I will await a response from Tikipod on this matter and if there is nothing further within the week, I will be removing the video from my channel and replacing it with another title.

*Sigh* It's still ongoing, although the claiming name has changed (was "One or more" and changed to Zimbalam):

-------------------------------------------------------------------------
"Electric Cafè-Mouldy Depths", sound recording administered by: 8:05
Zimbalam

Time to copy / paste the previous dispute letter...

Hi - the Zinbalam issue is not something we can directly control - you are best contacting Electric Cafe who made the music - as they hold copyright via Zimbalam.

http://electric-cafe.tumblr.com/

Contact emails are on their website above. They too have tried to contact Zimbalam to remove the audio from Zimbalams youtube checks, but Zimbalam have not replied to them,

Hence this rather annoying situation where we all want Zimbalam to no longer ad adverts but so far they have done nothing.

Thanks for clearing it up a little. For whatever its worth

Thanks for the information Tikipod,

Just a heads up as well to Tikipod and yourself osgZach, After the second dispute, they have released it and I have not had a Third applied at this stage. :)

Thank you both!

Hi, yes you can record the game for youtube (there are lots of videos already as you may have seen). But the music rights are owned by the music creators - and you may find you get a copyright claim from a 3rd company called Zimbalam (in which case a small advert appears over any video that can be click off)
