how do I lock fez to 60fps?

I KNOW there is an option in the launcher to force 60hz and also a command line.
the thing is, the game keeps running at 75+fps and there's tearing.

here's what I tried:
-Command line to force 60hz
-launcher option to force 60hz
-checked if my monitor was set to 60hz (it is)
-set vsync always on and on unless application specifies in catalyst control center.

but the friggin' game keeps running over 60fps

why is it ignoring every option that tells it to stay at friggin' 60?

I have an AMD 7970 card and running windows 8.1

if someone has a solution, please tell me, I tried everything I could think of and googling or seaching the forums didn't do anything for me.
