@Gmodism having seen many Kickstarter scams I don't think this is one of them (not intentionally at least). Considering the pre-alpha was already in a decent shape, I believe what happened is legal issues (hence also the radio silence).

With retro visuals, designs and sounds this is a legal mine-field. All it takes is one company or individual that thinks the game somehow trespasses on their rights, and the whole project gets stuck in legal hell.
