I use fpsmax 60 so my card doesn't heat up/run so high without reason. Every time I join a game/go back to menu, the fps jump past 120 and I have to enter fpsmax into the console again.

How do I make it stay that way permanently?

google dxtory. I use it to limit fps in ns2, you can save it once then forget it.
