Terms of Service are not stagnant. Stances on certain aspects of a game can change and be updated at any time, as they often are. Look at Blizzard: they used to shut down large scale Warcraft III modding projects that used ripped models from World of Warcraft. Now they don't care whether or not we use models from their other games as long as we are not trying to sell our work.
Best part is, EAC still does it's job, and you can happily use mods with friends that also have EAC turned off for the session
Irregardless, Bandai's TOS is pretty clear that Modding is NOT and never was, supported
QLOCK is the company in charge of Porting XV2 "and many other titles" from consol to PC, furthermore, devs prefer that you use their content as opposed to other content that could potentially clash with theirs. Asking a Japanese Game development company to support mods and create a whole other server is like trying to catch a Shark with some string and a flimsy stick.
