Technically changing the TOS to prevent a refund is illegal in most countries. I highly doubt the US allows this.
90% of the community has been demanding they fix the game. If that doesn't get them to do it then it won't happen at all. The other 10% are too dumb to know what they're doing so they just spend spend spend (mostly with their Mum's CC)
I thought i would give you all this as food for thought, i found a CV on the interwebz the other day.. this got removed from the official forums but should generate some laughs. It was patrick Kewk Bowmans CV from 2009.. now remember upon questioning it was kewks name they mentioned as being part of blops 2 dev... i dont think soooooo. He left the company early 2010.
This has since been removed from the forum which can be traced for those non believers should you question it, and the link to it.. has suddenly changed to say the CV was removed :( aaawww
He also credits himself with coming up and implementing Activisions entire DLC operation. A bold statement and also an untruth.
Anyway alot of people seem to think this game is not a scam, if we look at the simple facts and lack of ethics.. i think the general behaviour of Hammerpoint is probably summed up here

I see people have been waiting nearly 60 hours for their servers to come online..... and its 'crickets' from any dev about it on the forums.
