Legion life is hell. Take one moment to look at the dogma and it becomes clear that there’s no contest to be had:
-Are you a woman? Well ♥♥♥♥, right out the gate you have a life of nothing but pain and misery.
-Do you have a condition that needs surgery or medication? Too bad, you either die to the health complication or are put on a cross for using the technology of profligates (unless you yourself are Caesar in which case it’s totally fine to use it because that’s not hypocritical at all)
-Are you being absorbed into The Legion from a culture/society outside of it? Say goodbye to any family members, cultural identity, and/or religion you may have had before or you will be killed. You’ll be lucky if you’re even allowed to keep your hairstyle. It’s more likely they’ll go as far as throwing your favorite dogs into a fire
-Are you being born into The Legion? Well you’ve got the options of being born directly into enslavement, killed for having ambiguous genitalia or a health condition. Maybe you’ll be trained as a child soldier who will have such friendly inspiring people around you such as the trainer we see game threatening to throw a kid off a cliff unless they run faster
-Are you not heterosexual/cisgender? Jimmy’s experience makes it perfectly clear that The Legion will murder you if they find out that you’re not straight. Can probably expect similar attitudes toward gender
-Are you a heterosexual able bodied cisgender male that survived entering The Legion? Neat, hope you have no ideological differences from what the Legion doctrine states otherwise they’ll maim and/or kill you if they find out. Better be cool with slavery, the subhuman treatment of women, cultural genocide, public executions, mass murder and a whole lot more atrocities all day every day or The Legion will commit atrocities against you

Legion is basically for the 500lbs teenager in emo phase. Too emotional and delusional.
It's more like most people have no idea how their government works, what their rights are, what the government can and cannot do legally. As long as they feel safe they'll agree to anything.
An alarming number of people in our government don't know their jobs very well. We have prosecutors charging people with the wrong crimes or crimes that cannot be because they conflict with other laws and rights. Then we have judges that don't know their job and what they can dismiss or overturn, allowing idiot prosecutors to do their thing. There's not enough evidence and what they have is more speculative or circumstantial yet they allow it to be the standing argument. Sentencing people to prison that shouldn't be for too long on top of that. It's as if the judges don't even know why they're there, like a clueless referee with no discretion. They went to school to be a lawyer then a judge for the adventure a prestige but do not care about the people that face judgment. HOPE you NEVER have to go to court for anything serious.
ANYWAY! There is NO perfect solution, someone always wants power. And when it comes to the masses you'll always have idiots therefore regulations that SEEM harsh and unfair, especially when the one making the decisions is a cold harsh control freak. That's why it's a choice, you choose what you'll sacrifice. An imperfect system is better than chaos.
We have so many laws because people cannot be entrusted to not do something stupid, same goes for those who govern.
Ill try to keep this short, and the question is a bit rigged in my mind. We can easily point to the legion being the easy answer of the most ♥♥♥♥♥♥ up situation. It is in line to the ♥♥♥♥ we see with Islam, and other religious groups actions in the past or places where a caste system is still the law of the land (India, Aisa, Africa etc). But both factions are conjoined to one another in some manner or way, and both are spiraling out of control and using the war for society will be to do some pretty horrific stuff. You dont get a problem without the right things for a problem to occur.
NCR claims to be about freedom and democracy but is run by the mob, corporate interests and its own "democratic" identity is destroying its own nation. A term I will use lightly. The people are poor, poverty and joblessness run high, they dont have a working economy. Endless problems due to a hyper PC liberty dogmatic mindset which is focused on imperalism and a welfare state. As well as using methods to conquer places that the legion uses to grow stronger and sow the seeds of anti NCR agendas very well.
People in the legion dont have it easy as it is a human purist hyper breeding and eugenic enforced society. Sexist and anti technological to some degree with only the leader being able to bend the rules. however they have a working economy and if your.....say an independant trader from say.....Arizona you have it a lot easier if you just keep yourself and focus on honest work and trade. Legion has safer lands, no raiders or druggies or mutants, which means they are more productive in other areas. But if your a soldier or citizen of the legion you indeed are a cog in a moralistic dogmatic machine that is designed to do one thing: Have humanity survive the nuclear world at any cost. And the cost is indeed to high and horrific. Its almost tribally communistic.
I will say this, I would rather have a working economy than have all the "democracy" in the world. The people of both the legion and NCR do not have sane leaders, but instead their leaders are using old world values in the form of "survival" or "democracy" as a dogwhistle to continue their ignorant and imperialistic ways for saving humanity when its feeding a sick machine.
Both exist for one another, and I have to say both factions and their citizens have it bad. Because they are both dictatorships that see their dogmas as noble and legal. We can pretend that having "democacy" while being always poor and having endless issues at home is a good thing, but it isnt. Nor is having white supremacists (legion) with a working economy but an anti human mindset of purity. But the question is rigged because the legion is a exact opposite copy of the NCR. Both are ♥♥♥♥♥♥ even if they do have noble and moralistic dreams and ideals which make sense. And both are dictatorships.
But Only Mr house can save the world in my eyes and experience. He isn't living a dogma.
If the choice is given to you between being a woman in The Legion, or being a woman in the NCR, which are you going to choose?
Its a question of quality of life between two factions and its plainly obvious what the answer is
There's no ♥♥♥♥♥♥♥ way that the Legion is comparable to the NCR when the circumstances of your birth can leave you with a collar around your neck, performing physical labor under threat of torture and death, being routinely violated, and forced to give birth in order to perpetuate the whole miserable cycle and fuel the dictator's ♥♥♥♥♥♥ up visions.
~50% of the population stuck in a living nightmare every day of their life in The Legion. And that's just one demographic that they ♥♥♥♥ over.
As a side note: House straight up calls himself an autocrat and takes control of the region by force. He isn't any different than the NCR when he utilizes the same garbage techniques that the NCR does when they want someone out of the way (He kills The Kings after drumming up bs charges that they refuse to acknowledge) or to shake them down for resources. (He taxes Nipton heavily for "protection" fees if the option NCR is chosen by the player during sheriff quest).
