As for the rifle with the M1 Garand sights, that is awkwardly similar to the CoD weapon, I doubt Prassel had any idea that it was the same until this article came out. But he's right, that is not a DMCA issue.
If I had to guess, Activision saw an opportunity to target an indie dev with a coloured past, and absolutely picked a malicious time period such as the Steam Summer Sale.

But who am I, except some third party that doesn't care about either party, or either game. So maybe my unbiased opinion doesn't matter, but...maybe it should.

I just spent over an hour on the bus reading up on this, following links, reading comments, and here's my conclusion:

It's all anecdotal at best.

There's a lot of people talking like they know what's going on, but they're just parroting articles.

The emails and messages posted by this David Prassel are a better indication of his personality, which tells me a story of someone who is dedicated to his goals, but tries to micromanage and usually ends up overwhelming himself.

Genuinelly sorry to tell you guys/girls this tbh, i too see that ORION games could actually be great fun (if they didnt revolve around stolen content and constant 'new' game releases) but this guy is just the most toxic dev found on Steam.

And well, he's had his chance to redeem himself last time around, but he choose to continue as is (im thinking in part because Valve was fairly lackluster in that case, since it was 'just' indie vs indie they hardly did anything) and now hes been caught doing the exact same things again, only this time he's caught by a company that does have the funds to sue him, its gonna be interesting to see this unfold, at the very least Valve will have to take some action against this guy now, i hope.

I personally know one of his old (unpaid/lied too) developers btw, if anybodys wondering why im posting here without having any of his games.

1/2: Ima just post here to say some thruths, you know this was comming David, and you f*cking deserve it too, dont act like your beeing wronged here, anybody with half a brain still remembers how all your games got in the news not to long ago for stealing assets, in those cases it was about having stolen from indie developers (Unknown Worlds & at the time Lukewarm Media, from the games Natural Selection 2 & Primal Carnage) so you somehow got away with it (mostly because they cant afford lawsuits) but now that Activision has caught you redhanded, its over, i would strongly suggest removing all ORION games before other big publishers have a proper look, and your sued too personal bankrupcy.

2/2: For anybody reading this going agro because im ripping on your favorite dev, im sorry to do this to you, but its for your own good to avoid this guy, please read the below 2 links to learn why:

Last case of stolen assets (NS2 & PC):
How david treaths his employees (very bad):

Bye David, hope you get banned for life from Steam this time.

So it's not that entire guns were ripped from COD? It's that the parts of some COD guns were used to make up several different weapons in ORION? Is the what the complaint is about?

Fuck Activision, the pathetic bastards. All they want to do, is knock out the competition. Well fuck that! We are here for you David!
