At least there should be the option of confronting the person who ordered your death with the note. That should elicit aggression, so you can fight them, or perhaps an apology. And some money for letting them live.
The thugs are sent to teach you a lesson and they do. I hardly ever steal anything anymore, unless it is a quest objective (and I still wonder if you may get thug visits from those). If they didn't want you to steal in the game, why give you the option? They could just have made owned items non-interactive.
That's hilarious. I have yet to encounter anything like this.
For the most part, Skyrim avoids player traps, but I think these thugs were essentially unbeatable. I never got warning when I was stealing ingredients from Arcadia's shop.
Going in to the fight (at level 5), I was in all heavy armor, all of it Superior quality Steel. I had a 2 handed sword with an enchantment for fire damage, was using a potion of fortify health, fortify heavy armor, and poisoned my Superior Steel Greatsword with 4 seconds of paralysis. I had a hired mercenary with me, a stray dog, and a conjured familiar. How much more can a level 5 bring to the table? I even had the Lord Stone and the 25 hp Blessing of Arkay. I had at least 1 perk point in Heavy Armor and at least one in 2-H. When I'd get hit, I'd immediately use a potion to restore my health to full before taking another hit, but them BOOM, I get one-shotted.
Seriously, how much more can a level 5 bring to the table? I can't even kill one of the three usually. I guess in the future, I'll have to try bravely running away and see if that satisfies the encounter and they stop bothering me.
They will come more than once for MURDER though.
Like everything else in this game, they are beatable at any level by simply jumping on/off a rock and filling them with arrows.
I've had that happen to me as well when I've taken the note in Anise's basement, but the thugs were actually sent by Moira, the Hagraven involved in Sanguine's quest, even when she hasn't spawned in the game yet.
And the thugs still come after you even if you steal something as part of a quest objective. I had stolen the key to the Whispering Room in Dragonsreach from Farengar once so I could get the Ebony Blade. He sent thugs my way and I found he was behind it when I read the contract.
