How do you get the Spy knife "The Black Rose" in TF2? I know it's an achievement from a game, but how exactly?

Afaik SAM can get your account banned.
I'm pretty sure that it would only get you banned if you do it while playing a game. I never heard of someone actually getting banned by it.
