How to get unbanned - for all the legit players who have been banned by careless GM's
This information if for people who are unfairly banned and also for the Legend and Pioneer players who still have not recieved the package they paid for. Its time you Legends and Pioneers did something about the lack of strongholds....

1/ submit a ticket to support and sit back and wait for the never reply ... or worse the reply that claims you hacked when you didn't .... and this 'evidence' is too sensitive to show you.

2/ Get down to business, dig out the EULA and look up section 15. In part A it has instructions on how to start an informal dispute. Doing this will force OP Productions to deal with your false ban and take the 6 week wait from the support desk out of the equation (which will only result in them lying to you anyways)

here is the Section from the EULA that you need :

15. Dispute Resolution.
a. Informal Negotiations. To expedite resolution and control the cost of any dispute, controversy or claim related to this Agreement ("Dispute"), You and OP Productions agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 30 days before initiating any arbitration or court proceeding. Such informal negotiations shall commence upon written notice from one party to the other. OP Productions will send its notice to Your billing address and email You a copy to the email address You have provided to us. You will send Your notice to OP Productions, OP Productions LLC., c/o The Corporation Trust Company, 1209 Orange Street, Wilmington, DE 19801, USA.

3/ If after 30 days of an informal dispute you can proceed to part B of section 15 in the EULA, this covers BINDING arbitration. It also says in that part that if the arbitrator (a specific organization is quoted as the one to use) deems that the cost of you taking part in the mediation is excessive then OP Productions are obligated to pay 100% of the fees and expenses, It is likely that flying to California would be deemed excessive, so win win for you if HP dont unban you during the 'informal dispute'

NOTE : IF you follow step 2 and 3, this gives you the right to sue them in court for your money back etc etc, My laywer is the one who told me to follow these steps after he read the EULA when I wanted to sue them.

Anyways at the very least you will get away from the useless zendesk that sends out copy and pasted lies because they are so swamped with ban appeals due to the fact that they ban legit players every day..... I'm still waiting for replies to tickets that are 40 days old ..... dispute resolution is only 30 days .... and OP Productions have to deal with you directly, instead of the crappy zendesk.

I am curious though.

Have YOU yourself gone any further with this? Because it's easier to help people when you've gone through the whole process yourself

I am going thru the process as we speak..... I have definitly had my fair share of attempts thru the support desk. That place is a joke.

I sent them a cease and desist letter at first , asking them to stop the defamation of my known alias on twitter (they used to have a feed called warzanticheat and tweet everytime they ban someone) I see after sending the letter the new feed doesnt have the word anticheat in it .... LOL

Anyways my lawyer advised me to follow these two steps to be eligible to sue them. SO I am currently waiting for the informal dispute process to start, I have sent the letter but it takes ten days to arrive from New Zealand. The longer you wait, the longer it will take to go thru those steps, so I advise you do it ASAP.

All you need to do is type up a letter advising them of the informal dispute and the reason why, include the billing email address you use and your player name. This will get the ball rolling, if after 30 days they have not unbanned you, then atleast you can get an independant third party to mediate (all the info about how that is done is covered in section 15, part B of the EULA)

Assuming this thread isn't deleted within the next 12 hours or so, I'm subbing. I would love to know where this goes from here.

The more people who do it, the more swamped they will get with legitimate customer concerns and not be able top pawn the problems off to the 'copy and paste' desk so i suggest everyone else who is unfairly banned to send the letter starting an informal dispute, it only costs you a postage stamp. And is the best way to make the company address the real problems, 'the doctor is in' informed me that the zendesk is told to send out copy and paste replies, so thats why you always get the lies when you mail them..... avoid the zendesk, make the company deal with you directly .... section 15 of the EULA is the way to do that :)

well i got banned on my second account for no reason.too
[!]FreaKtm Jul 12, 2013 @ 3:32am
send them a letter in as described in the EULA, lets force them to deal with us instead of ignoring us and then banning us in the hope we will rebuy the game. Everyone who has been unfairly banned, or is a Legend/Pioneer should do it. If they dont respond to the informal dispute , then you can force them into BINDING mediation and we all know what way the mediator will go when presented with the facts ..... full refund.

Well since i bought this game on steam, cant steam just refound me, so i dont have to deal with all this hammerpoint bs support?
Ravenknight Jul 12, 2013 @ 3:01pm
@RaidenFox: that sort of misses the point. It's really more about the principle. FreaKtm seems to have finally had enough of being pushed around and blown off by this developer. He could just take the easy way out and walk away from the whole thing, chalking up his monetary loss to a "charitable donation". That is exactly what this developer (and all other developers using EULAs like this) is betting will happen with 99% of their disgruntled customers.

Jumping on this one. banned 2 weeks ago after a long 7 month service with varing micro transactions and over 300 hours play (i bought whilst it was banned from steam so missing some time off my data). i wasn't even on when i got banned, i looted, went to bed, tried to log on next day and BAM!!! perma ban. typing my letter tomorow.

seriously tho I think steam need to jump on this and ban them again

just so u know ppl if u didn't hack and can prove it THIS IS FRAUD BY ABUSE OF POSITION UNDER UK LAW.
tonyrulesu Jul 12, 2013 @ 7:23pm
I completely agree about this. I think that they need to clean up there act and be like a REAL developer. Look at nexon and companies like that. Once hacked a game called Combat Arms when i was about 8. Next day banned.
tonyrulesu Jul 12, 2013 @ 7:26pm
Also, look at it from there point. They are just trying to clean up the game servers from hackers. But they should be careful. I bet you anything, i havent even been on yet, that when I do, ima not be able to get on. Which i am taking screen shots as we speak on my download progress
[!]FreaKtm Jul 12, 2013 @ 7:50pm
i am going to type up template letters for Pioneers, Legends and Unfairly banned players later today (im about to head off to the movies), three different templates for the three different scenarios. I will link them here as an easy way for people to go thru the process by just filling in the blanks and posting it off so that people dont all need to spend time typing the letter up
GrayWolf448 Jul 12, 2013 @ 8:41pm
i cant believe im a Legend player and still haven't been banned i must be lucky ^^
im still waiting for my 6 month stronghold server they said it will be in on dec. 30. 2012 and it's 2013 now -_-. also didn't get my guest passes before they all got disabled and still don't have them -_- but i have no loyer or anything like that only 14 :/
[!]FreaKtm Jul 13, 2013 @ 12:25am
you dont need a lawyer graywolf, anyone who is a customer can file for informal dispute and then mediation.... when i put up the template letters i urge you to use the one for legend players and get your parents to pay the postage fee... its the only way to fight the injustice
Ravenknight Jul 13, 2013 @ 2:19am
Is this about fighting the injustice or merely squaring accounts? Both are equally admirable goals but each has a different level of commitment. Squaring accounts means they unban your account (with no guarantee you won't be banned again of course) or grant the refund. Fighting the injustice entails a much more long term goal requiring patience, fortitude, and a willingness to go "all the way" irregardless of the threats, public exposure, financial burden, etc. Be VERY cautious and make sure you get a much more thorough consultation before waving the Crusader flag, lest gamers in general end up even more marginalized then we already are.
