Banished.
Edit: Actually, things seem to have progressed a bit since I read his post. It looks like its changing ownership now, instead.
If the game gets a new main dev, it still doesnt mean a lot, until we see how and what will he do with the game. It can be great if the person is serious and professional, or it can be same as now, so in the end nothing changes
The Towns dev:
"Quick news!
Yesterday, late at night, I talked with the guy that, almost for sure and if nothing goes wrong, will take the lead of Towns. We still have to sign some agreements and set the initial work conditions, but I have a pretty good feeling about it."
"Towns v14b will be the last build we will release as SMP. I have no words or response of why I didn't post this months before. The only thing I can say, and I understand you don't care about it, is that I'm burned, really burned about the game and all it involves. I don't have the strenght to continue with it.[/b]
At some point we tried to hire someone to continue with the development, we also did some interviews to some nice coders. But at the end I messed that, because I'm so burned to show the code to other guy and explain him how all works. So we cancelled the hiring thing."[/b] - Xavi;

It is so funny that Xavi suddenly isnt burned anymore and is hiring a programmer to fix all the mess he did, just to get some more profit until the game is abandoned forever. This guy is probably one of the biggest liar and hypocrite in the Indie-scene. Nevertheless it is totally legit if he does not want to give it for free to the community by making Towns open-source since Towns is still his possession but he is currently gambling with his credibility as devolper/publisher of a game in the future.
Well, if you want to talk really about it, he is still burned, thats why he is giving the whole development to other person without showing him anything xD. Going open source would probably mean more work for him, than giving it to other dev.
Towns should go open source as the last thing they can do, because if it goes open source, it would directly mean dev has forever abandon the game.
If he gives the game to another dev, that makes a miracle and finish the game, that will actually make him "redeem" (if its posible at all) his action more than giving the game to open source.
Open source is biggest gamble generally if you think about it. Another dev working on game is not, because even if it doesnt work he could than go open source in end, but there is no back from open source (i think).
It would be a lie to say he is doing it for the sake of the community after abondoning us for about 10months.
Yes, and? You see he said he is so burned out so he doesnt want to show the code to someone. So he is now searching to get one where he will not need to show it at all, and a guy that will do everuthing, so xavi doesnt need to do anything xD.
